Elia Press provides custom creative and business services, including photography, headshots, events, video production, content creation, influencer marketing, brand strategy, and website builds. Specific scope, timelines, deliverables, usage rights, fees, and approval steps should be confirmed in a written proposal, invoice, or agreement before work begins.
02Inquiries and quotes
Submitting a contact form does not create a client relationship or guarantee availability. Quotes, package examples, and website pricing shown on the site are starting points and may change based on scope, timing, usage, licensing, travel, production needs, rush work, third-party costs, and requested deliverables.
03Bookings and payment
A project is booked only when the required payment, retainer, deposit, signed agreement, or written confirmation has been completed. Deposits and retainers may be non-refundable once a date is reserved, planning begins, production starts, or capacity is held for the client.
Clients are responsible for paying approved invoices, third-party expenses, platform fees, permit fees, travel, rentals, talent, locations, advertising spend, or other costs that are part of the agreed scope.
04Client responsibilities
Clients are responsible for providing accurate project details, brand assets, access, approvals, feedback, event schedules, locations, permits, releases, permissions, and any materials needed to complete the work. Delays in client feedback, approvals, payment, or access may shift timelines.
05Revisions and approvals
Included revisions should be defined in the project agreement. Extra revisions, scope changes, new deliverables, reshoots, redesigns, or rushed changes may require additional fees and timeline changes. Final approval may be required before delivery, launch, publishing, or transfer of files.
06Usage rights and portfolio use
Elia Press keeps ownership of underlying creative work unless a written agreement says otherwise. Clients receive the usage rights described in the relevant proposal, invoice, license, or agreement. The work may not be resold, relicensed, heavily altered, used for unlawful purposes, or used outside the agreed scope without written permission.
Elia Press may display completed work, behind-the-scenes material, testimonials, and results in portfolios, social media, case studies, and promotional materials unless the project agreement says otherwise or a written confidentiality restriction is approved.
07Website projects
Website work may involve platforms, hosting, domains, analytics, forms, third-party apps, embeds, payment processors, fonts, stock assets, plugins, and other services that are not controlled by Elia Press. Unless specifically included in the written scope, legal compliance, accessibility audits, cookie management, privacy compliance, hosting, maintenance, search ranking, ad performance, and ongoing updates are not guaranteed.
08No guaranteed results
Creative, marketing, strategy, content, influencer, website, and advertising services can improve presentation and execution, but results are affected by many factors outside our control. We do not guarantee sales, bookings, views, conversions, ranking, press, sponsorships, engagement, or any specific business outcome.
09Cancellations and rescheduling
Cancellations, rescheduling, weather delays, illness, venue changes, event changes, access issues, no-shows, and late arrivals may affect fees, deliverables, and availability. The refund and cancellation policy applies unless a signed project agreement says otherwise.
10Liability
To the fullest extent allowed by law, liability is limited to the amount paid for the specific service giving rise to the claim. Elia Press is not responsible for indirect, incidental, special, consequential, punitive, lost-profit, lost-opportunity, platform, third-party, or business interruption damages.
11Law and updates
These terms are intended for a Canada/Ontario-facing creative business unless a specific agreement says otherwise. We may update these terms as services, tools, or legal requirements change. Continued use of the site after updates means the updated terms apply to future website use and inquiries.
These terms are a practical website baseline and should be reviewed by a lawyer before relying on them for high-value projects, unusual licensing, regulated industries, or cross-border campaigns.
