Elia Press provides custom creative and business services, including photography, headshots, events, video production, content creation, influencer marketing, brand strategy, and website builds. Specific scope, timelines, deliverables, usage rights, fees, and approval steps should be confirmed in a written proposal, invoice, or agreement before work begins.
Submitting a contact form does not create a client relationship or guarantee availability. Quotes, package examples, and website pricing shown on the site are starting points and may change based on scope, timing, usage, licensing, travel, production needs, rush work, third-party costs, and requested deliverables.
A project is booked only when the required payment, retainer, deposit, signed agreement, or written confirmation has been completed. Deposits and retainers may be non-refundable once a date is reserved, planning begins, production starts, or capacity is held for the client.
Clients are responsible for paying approved invoices, third-party expenses, platform fees, permit fees, travel, rentals, talent, locations, advertising spend, or other costs that are part of the agreed scope.
Clients are responsible for providing accurate project details, brand assets, access, approvals, feedback, event schedules, locations, permits, releases, permissions, and any materials needed to complete the work. Delays in client feedback, approvals, payment, or access may shift timelines.
Included revisions should be defined in the project agreement. Extra revisions, scope changes, new deliverables, reshoots, redesigns, or rushed changes may require additional fees and timeline changes. Final approval may be required before delivery, launch, publishing, or transfer of files.
Elia Press keeps ownership of underlying creative work unless a written agreement says otherwise. Clients receive only the usage rights expressly described in the relevant proposal, invoice, license, or agreement. Deliverables may not be modified, adapted, edited, transformed, resold, relicensed, used for unlawful purposes, or used outside the agreed scope without Elia Press's prior written permission, except for technical resizing or formatting expressly allowed by the applicable agreement.
Deliverables, drafts, source files, project files, photographs, video, audio, designs, copy, concepts, and any other materials supplied by Elia Press must not be uploaded, submitted, disclosed, incorporated into, or otherwise used to train, fine-tune, test, evaluate, benchmark, prompt, develop, improve, or provide input to any artificial intelligence, machine-learning, generative, automated learning, or similar model, system, dataset, or service without Elia Press's prior written permission. This restriction applies whether the use is commercial or non-commercial and whether performed directly or through a third party.
Each unauthorized modification, use, upload, submission, disclosure, or other prohibited act is a separate violation. To the fullest extent permitted by applicable law, Elia Press may invoice each violation at the maximum lawful license or usage fee applicable to that act, together with reasonable investigation, takedown, professional, collection, and enforcement costs. This does not limit Elia Press's right to seek actual damages, statutory damages, injunctive relief, an accounting of profits, or any other remedy available under contract, copyright, or other applicable law.
Elia Press may display completed work, behind-the-scenes material, testimonials, and results in portfolios, social media, case studies, and promotional materials unless the project agreement says otherwise or a written confidentiality restriction is approved.
Website work may involve platforms, hosting, domains, analytics, forms, third-party apps, embeds, payment processors, fonts, stock assets, plugins, and other services that are not controlled by Elia Press. Unless specifically included in the written scope, legal compliance, accessibility audits, cookie management, privacy compliance, hosting, maintenance, search ranking, ad performance, and ongoing updates are not guaranteed.
Creative, marketing, strategy, content, influencer, website, and advertising services can improve presentation and execution, but results are affected by many factors outside our control. We do not guarantee sales, bookings, views, conversions, ranking, press, sponsorships, engagement, or any specific business outcome.
Cancellations, rescheduling, weather delays, illness, venue changes, event changes, access issues, no-shows, and late arrivals may affect fees, deliverables, and availability. The refund and cancellation policy applies unless a signed project agreement says otherwise.
To the fullest extent allowed by law, liability is limited to the amount paid for the specific service giving rise to the claim. Elia Press is not responsible for indirect, incidental, special, consequential, punitive, lost-profit, lost-opportunity, platform, third-party, or business interruption damages.
These terms are intended for a Canada/Ontario-facing creative business unless a specific agreement says otherwise. We may update these terms as services, tools, or legal requirements change. Continued use of the site after updates means the updated terms apply to future website use and inquiries.
